In light of disturbing allegations regarding an incident of sexual assault involving members of the Chi Phi fraternity at Cornell University, a student known as Jane Doe has taken legal action against the university, the fraternity, and several individuals associated with it. Central to the case is a series of messages shared within a fraternity group chat on Snapchat, which Doe claims highlights the environment surrounding the alleged assault.

Following her exposure to these messages, which referenced “free p—-” in connection with a gathering at the fraternity house, Doe decided to approach law enforcement, believing it was her responsibility to assist a fellow student. “That was, like, when I kind of internally made the decision. OK, like, I’m taking this all in, and then I’m going to the police tomorrow,” she recalled about her thought process.

During a police interview, Doe described her experience as overall positive and found the officers to be competent. She shared detailed information, including the fraternity’s activities on the night in question, potential witnesses, and secondhand accounts of drug use within the fraternity’s premises—specifically mentioning where ketamine might be kept. Despite her extensive input, she expressed feelings of inadequacy, stating, “I guess I assumed that, like, I wasn’t enough.”

Authorities at Cornell have yet to comment directly on Doe’s claims. However, university president Michael I. Kotlikoff has expressed concern over the implications of the allegations, recognizing them as “deeply disturbing” and prompting a call for an independent investigation into how the university managed the situation. This review will reportedly be led by an outside legal firm.

Police records obtained by NBC News reveal that Cornell police conducted numerous interviews and received various anonymous tips related to the accusations of gang rape at the fraternity. However, this critical information was reportedly not forwarded to the local prosecutor for further legal action. Tompkins County District Attorney Matthew Van Houten indicated that interviews conducted with fraternity members resulted only in their refusal to cooperate, citing advice from their attorneys. Ultimately, he concluded that the allegations lacked sufficient evidence to warrant criminal charges.

Doe’s lawsuit has ignited considerable controversy and criticism directed at both Cornell and the prosecution’s handling of her allegations. In response to the growing discontent, Van Houten has agreed to revisit his inquiry into the matter, with New York Governor Kathy Hochul appointing Attorney General Letitia James as a special prosecutor overseeing the case.

The student who reported the incident has criticized the way campus police handled the situation. Despite ongoing perceptions of an active investigation into Doe’s claims, the fraternity remained operational, with students continuing to visit Chi Phi, including the specific room where the alleged assault occurred. “Within Greek life at Cornell, rumors spread fast,” the student noted, emphasizing the college environment’s interconnected social landscape.

The lawsuit has named Cornell University, Chi Phi fraternity, and seven fraternity members as defendants, none of whom have faced criminal charges to date. The fraternity has been suspended from campus indefinitely. In a statement issued on September 28, university representatives claimed that a comprehensive Title IX investigation was completed, leading to various sanctions, including expulsions and suspensions.

Attorneys representing two of the men involved have denied the allegations against them, while a third attorney has similarly dismissed the claims. Responses from the remaining defendants are still pending. Meanwhile, the national Chi Phi organization expressed its condemnation of sexual misconduct and related violations, indicating that the fraternity members named in Doe’s lawsuit were expelled from the national chapter, which has also closed the local chapter permanently.

As the situation developed, backlash against some fraternity members was reported on campus. Two individuals named in Doe’s lawsuit were expelled from their rugby team amid these allegations. An anonymous former teammate revealed, “We kicked [them] off the team immediately before the school expelled them.” This teammate noted ongoing discussions among team members regarding public support for Doe, expressing urgency in rallying behind her.

As students discussed the alleged incidents, reactions within the community varied. A former member of Doe’s sorority, Delta Delta Delta, indicated that while some expressed sympathy for Doe, others lacked detailed knowledge of the situation, leading to confusion. Another student reflected on the general outrage circulating on campus, stating, “people were really pissed off about it.”

Concerns have also been raised regarding how Cornell has approached the issue, with criticism directed at the institution for perceived indifference towards female students’ safety. In response to the incident, the sorority has voiced strong support for Doe, reinforcing their commitment to victims of sexual violence.
