In an important development for the European crypto market, the European Securities and Markets Authority (ESMA) has advised that registered crypto service providers in the EU should pause operations tied to stablecoins that do not comply with the Markets in Crypto-Assets (MiCA) framework.
On October 8, ESMA’s directive highlighted a broad scope of services affected by this compliance gap. The notice indicates that licensed crypto asset service providers must discontinuing offerings that pertain to asset reference tokens and e-money tokens that aren’t aligned with MiCA requirements.
This extensive reach means activities such as trading, asset exchanges, custody services, remittances, order execution, investment advice, and portfolio management could be under scrutiny. Consequently, exchanges cannot circumvent regulatory obligations by simply removing a problematic trading pair while continuing other related services.
For issuers of stablecoins, access to regulated platforms is crucial for maintaining liquidity and extending market reach. The repercussions for exchanges may include fragmented customer access. Consequently, dollar-pegged assets commonly utilized in other regions may face restrictions for EU clients if they fail to meet the necessary authorizations and compliance criteria.
ESMA’s opinions serve as guides to supervisory expectations, indicating that while some stablecoins may not explicitly dispute compliance or signal enforcement on specific platforms, caution is warranted. Users should not confuse announcements of token delistings as indicators of loss of the peg, as the primary concern revolves around the legal ability to deliver specific services within designated markets. Companies must diligently assess their offerings in relation to these regulatory boundaries.
