Canada must stop dragging its feet on crypto regulation

The Canadian cryptocurrency landscape is experiencing noteworthy changes, particularly with the enactment of the Stablecoin Act. This recent legislation provides a federal framework governing government-backed stablecoins, distinguishing them as payment instruments rather than securities, a classification that has historically encompassed all cryptocurrencies.

Eric Richmond, CEO and country director of Coinbase Canada, has highlighted the significance of this law as a milestone for financial innovation that is influencing the broader market. For instance, six major banks in Canada have embarked on a collaborative initiative aimed at developing shared infrastructure for tokenized deposits, which have recently received validation from the Office of the Superintendent of Financial Institutions as being legally comparable to traditional deposits.

Current Challenges in Crypto Regulation

Despite this progress, the path to launching a digital assets business in Canada remains fraught with complications due to a patchwork of regulations that vary across provinces. Although the Stablecoin Act is anticipated to enhance clarity and create more predictable regulatory pathways, the implementation of this framework will take additional time—specifically two months post-consultation, which follows six months since the law’s initial passage.

The fragmented regulatory environment in Canada is a concern, as the nation currently lacks a national securities regulator. This absence means that different provinces can establish their own crypto rules, complicating the regulatory landscape for digital asset companies. A unified regulatory framework would simplify compliance and provide a singular rulebook that could facilitate the growth of the digital assets market across Canada.

Advocacy and Requirements for Reform

The Canadian Bitcoin Consortium has emphasized the necessity for cohesive regulations, noting that most digital asset issuers and platforms will continue to navigate multiple regulatory systems involving both the Bank of Canada and the Canadian Securities Commission. This overlapping oversight imposes significant compliance burdens on businesses.

Given that approximately one in four Canadians owns cryptocurrency—a figure that has sharply risen since 2023—the demand for a standardized regulatory model is urgent. A recent survey by the Ontario Securities Commission underscores this growing interest in digital assets, indicating that regulatory clarity is essential to meet public expectations.

The Path Forward

Currently, regulatory oversight of digital assets in Canada is inconsistent, relying on temporary “staff notices” from various regulators rather than a comprehensive framework tailored for cryptocurrencies. The implications of this inconsistency could hinder the tech sector’s recruitment efforts, especially for startups facing critical talent retention challenges exacerbated by regulatory delays.

To address these challenges, there is a call to consolidate existing exemptions and guidelines into a cohesive legislative framework. Such a move would pave the way for clearer licensing procedures and registration processes for digital asset businesses, ultimately reducing legal uncertainties and facilitating innovation.

Global Context and Comparison

Internationally, there is a rapid evolution of regulatory frameworks surrounding digital assets. The European Union has advanced its Markets in Crypto-Assets (MiCA) regulation, while the United Kingdom and the United Arab Emirates are formulating their own structures to ensure a conducive environment for crypto businesses. In contrast, Canada’s slower regulatory response places it at risk of falling behind global standards.

While the U.S. has faced its challenges, with the recent failure of the Clarity Act in the Senate, regulatory efforts continue to evolve, particularly through the SEC’s initiatives. For Canada to maintain its position as a leader in the burgeoning cryptocurrency market, accelerated and cohesive regulatory reforms are critical.
