Crypto industry poised to thrive despite the challenges surrounding the CLARITY Act.

According to Matt Hougan, Chief Investment Officer at Bitwise, the resilience of the crypto sector will prevail despite the current challenges faced by the CLARITY Act in the U.S. Senate.

With the Senate summer session drawing to a close on August 10, and the last working day slated for August 7, time is running short to secure a vote on H.R. 3633. Should a motion to halt debate not be introduced by August 5, any procedural movement on the bill would be delayed until the fall of 2026.

Despite earlier discussions, the Senate’s current agenda appears solely focused on personnel matters and budget resolutions, leaving the proposed regulation for digital assets stagnant since it was added to the calendar on June 1. The House of Representatives had previously passed the bill in July 2025 followed by a favorable review by the Banking Committee in May 2026.

Recently, Republican Majority Leader John Thune expressed optimism, anticipating that a vote on the CLARITY Act could occur before the recess. Thune stated, “I think we’ll have a vote on market structure. Whether we can move to consideration remains to be seen.”

The major hurdle at present lies with the Democratic contingent, who have indicated they will not proceed until the ethics block issue is rectified by the White House. Republican Senator Thom Tillis acknowledged the absence of a solid consensus on this matter.

Polymarket currently assesses a mere 15% chance that the CLARITY Act will be enacted by year-end, a significant decrease from an 82% likelihood in February.

What the Future Holds for the Bill

Hougan suggests that even if the vote is unsuccessful this week, the fate of the CLARITY Act may remain ambiguous. He posits that the bill may morph into a “zombie,” surviving without definitive support but lingering in political discussions.

“Nothing can kill it, but it will keep stumbling along,” he remarked.

He speculates that the issue might be revisited in more favorable conditions during the upcoming September or December sessions, particularly during the lame-duck session, where comprehensive bills often undergo a revisory process.

Hougan emphasizes that the ongoing regulatory uncertainty continues to dissuade many professional investors from entering the digital asset market. He views a price drop below 20% on Polymarket as beneficial, potentially allowing the topic to recede from immediate discussions and paving the way for industry growth in the fall.

Examining Regulatory Alternatives

In reference to an interview with SEC Chairman Paul Atkins, Hougan noted that the Securities and Exchange Commission is poised to introduce new regulations mirroring many provisions of the CLARITY Act.

“In the short term, SEC rules under Atkins are likely to be more crypto and innovation-friendly than the regulations that would result from a bipartisan congressional bill. They might even act as a catalyst. The risk is that the next administration could appoint a less favorable Commission chair,” Hougan pointed out.

Despite uncertainties, he contends that a new chair at the SEC would not reverse the substantial advancements achieved in the crypto landscape. He provided several key developments as follows:

  • The Bitcoin ETF has emerged as BlackRock’s most lucrative exchange-traded fund.
  • Major financial institutions like Nasdaq and JPMorgan are progressing towards tokenization.
  • Payment giants such as Visa, Mastercard, and Stripe, along with Coinbase, are on the verge of launching a stablecoin platform.
  • Robinhood has unveiled its own blockchain integrating features from Uniswap and Morpho.
  • The Office of the Comptroller of the Currency granted trust licenses to industry leaders like Circle, Ripple, and Paxos.

Hougan believes that the industry has a cushion of at least two and a half years before potential new regulatory changes could take place, articulating that “the genie can’t be put back in the bottle” when it comes to innovation in the sector.

Drawing a comparison to the telecommunications reforms of the 1990s, he highlighted how legislative delays did not hinder market advancements, ultimately resulting in the launch of significant internet companies even before formal regulatory approval was secured.

“Congress needs to pass the bill — the sooner, the better for the entire industry. The CLARITY Act is certainly not without flaws, but overall it’s a strong and timely document,” Hougan concluded.

Additionally, U.S. Treasury Secretary Scott Bessent has publicly urged the Senate to expedite the vote on the CLARITY Act, attributing delays to political maneuvering from the Democratic side.
