Virtual currency kiosks, often referred to as crypto ATMs, are becoming increasingly common throughout North Carolina, appearing in diverse locations such as convenience stores, malls, and gas stations. While these machines offer convenient access to digital currencies, they have also drawn the attention of scammers, particularly preying on older adults. In response to this alarming trend, House Bill 920, known as the Virtual Currency Kiosk Act, has garnered bipartisan support in the North Carolina House of Representatives.

The regulatory landscape surrounding these crypto kiosks is notably less stringent than that of traditional financial institutions. This lack of oversight has made it easier for fraudsters to exploit individuals, convincing them to deposit significant amounts of money under false premises, such as fictitious fines or emergencies. Once victims have completed transactions, retrieving their funds proves to be nearly impossible.

House Bill 920 seeks to rectify this issue by classifying crypto kiosk operators under the state’s Money Transmitters Act and placing them under the jurisdiction of the Office of the Commissioner of Banks. This important regulatory move aims to improve accountability for operators and establish robust operational standards.

The legislation goes beyond mere oversight, introducing proactive consumer protections that can significantly mitigate risks for users. A crucial feature of the bill mandates interactive fraud screening prior to finalizing transactions, allowing consumers to pause and reconsider their decisions, especially when under duress. The prohibition of QR-code or camera-based logins—common tactics used in scams—aims to close off vulnerabilities that perpetrators often exploit.

Moreover, the bill ensures that users have access to immediate support by requiring live customer service availability throughout operating hours, which could help thwart potential financial losses. Additionally, capping transaction fees at 14% seeks to protect consumers from exorbitant charges.

Acknowledging that different customers face varying levels of risk, House Bill 920 introduces a 48-hour hold on transactions for novice users and offers full refunds for fraudulent activity involving these individuals, providing essential safeguards against scams.

While detractors may contend that heightened regulations could inhibit innovation, it is vital to recognize that consumer confidence is fundamental to any thriving financial ecosystem. Without adequate protections, the overall market may become susceptible not only to fraud but also to a significant decline in public trust.

In addition, the bill empowers local governments with the authority to implement zoning and land-use regulations, thus allowing communities to influence how and where crypto kiosks are established.

North Carolina Senator Bill Rabon stands at a pivotal moment regarding this legislation. House Bill 920 represents a strategic approach to balancing innovation with consumer safety. Following its unanimous passage in the House, it is now crucial for the Senate to advance this essential bill, ensuring that consumers are safeguarded and that accountability in the ever-evolving realm of digital finance is achieved.
