President-elect Donald Trump is seeking a stay of the verdict handed down Friday in the hush money case, according to a court filing made public Monday.
“The court cancels the sentencing hearing scheduled for January 10, 2025, and confirms that President Trump’s immunity appeal is complete and final,” Trump’s lawyers said in a Sunday filing with Judge Juan Melchan. Further deadlines for the lawsuit should be postponed until it is resolved.”
In his ruling last week, Marchan denied Trump’s request to dismiss the case and ordered sentencing to continue on 34 felony counts of falsifying business records this week ahead of Inauguration Day.
Trump is appealing those decisions to the state appellate board later today, and is entitled to an “automatic stay,” according to the filing.
President Trump’s press secretary, Stephen Chan, said in a statement that the sentence was “unlawful.”
“The Supreme Court’s historic immunity decision, the New York State Constitution, and other established legal precedents command us to immediately dismiss this worthless hoax,” he said.
NBC News has reached out to Manhattan District Attorney Alvin Bragg’s office for comment.
Marchand said in Friday’s ruling that he did not intend to jail Trump and would likely sentence him to unconditional release, meaning he would remain a convicted felon but subject to no other punishment.
