South Korea’s Virtual-Asset Taxation Plans and Ongoing Legislative Debates

As the implementation of virtual-asset taxation approaches, the South Korean government remains committed to executing its plan on schedule for January next year. In response to rising debates within political circles regarding potential delays, a closed-door meeting involving officials from the Ministry of Economy and Finance and representatives from cryptocurrency exchanges is slated for October 19.

Key Details of the Taxation Framework

Under the proposed tax structure, a 22% tax, encompassing local levies, is set to apply to annual virtual-asset income that exceeds the 2.5 million won (approximately $1,810) threshold. This taxation scheme has sparked considerable discussion, with various amendment bills currently under consideration by the National Assembly.

Legislative Developments and Competing Proposals

Several lawmakers have submitted competing amendments, reflecting a significant divide in opinion on the matter:

  • Some proposals advocate for the repeal of the tax altogether.
  • Others suggest modifications to the timing of the tax’s implementation, advocating for a delay between two to three years.
  • A notable revision suggests that taxation should commence two years after the full implementation of the Crypto-Asset Reporting Framework (CARF), which will align with international standards and data access.

Among those calling for a delay are members from both the ruling party and the opposition. Notably, Democratic Party lawmaker Park Min-kyu has pushed for a revision that would synchronize the commencement of taxation with the entry of the United States into CARF in 2029. In contrast, the People Power Party is advocating for an outright repeal of the taxation plan, deeming it premature.

Voices Supporting Immediate Implementation

Conversely, some lawmakers are firmly in favor of proceeding with the taxation as originally scheduled. Democratic Party lawmaker Oh Ki-hyoung emphasized during a parliamentary audit on October 6 that the intention behind legislative frameworks was to implement them as soon as they are ready. Similarly, Lawmaker Jung Tae-ho voiced strong support for moving forward, stating that delaying the plan further would undermine previous commitments.

Upcoming Deliberations

Following the closed meeting on October 19, the next significant discussion will take place in November at the tax subcommittee of the National Assembly’s Strategy and Finance Committee. Key issues expected to arise will focus on timing of implementation, governmental readiness, and unresolved matters from previous audits, including loss carryforwards and the tracking of overseas transactions.

As these debates unfold, the future of virtual-asset taxation in South Korea remains a pivotal topic that intertwines fiscal policy with the evolving landscape of cryptocurrency regulation.
