The hard truth is that the Clarity Act is an anti-crypto bill

The recent introduction of the Clarity Act has sparked considerable discussion within the cryptocurrency community. While it carries the nomenclature of a pro-crypto bill, a closer examination reveals a predominant focus on regulating intermediaries rather than directly enabling the innovative technology behind cryptocurrencies.

The Promise of Decentralization

The inception of cryptocurrency can be traced back to the Bitcoin whitepaper, published in the wake of the 2008 financial crisis. This pioneering document underscored the limitations of “trusted third parties,” which had become points of failure in the financial system. By integrating cryptography with internet technology, cryptocurrencies aimed to eliminate these intermediaries and facilitate secure peer-to-peer transactions.

The vision was clear: to construct a decentralized financial ecosystem that empowered users and reduced reliance on traditional intermediaries.

A Bill for Intermediaries

However, an analysis of the Clarity Act suggests a different trajectory. The legislation primarily centers around entities such as exchanges, brokers, and custodians, which act as intermediaries in the cryptocurrency market.

According to assessments of the bill’s text, a mere 2% to 4% addresses the underlying technology of cryptocurrencies, while between 44% to 77% speaks to intermediary structures and regulations—these figures vary depending on the legislative draft being analyzed from either the House or Senate committees.

This trend mirrors a hypothetical scenario where a proposed legislation on medicine would devote the majority of its attention to the distribution methods via major retailers like Walmart and CVS rather than focusing on safety, efficacy, or quality standards for the medications themselves.

Conclusion: A Shift in Focus

As it stands, the Clarity Act may reinforce the existing ecosystem of cryptocurrency intermediaries rather than champion the decentralized nature that the technology initially promised. Stakeholders within the crypto sphere might need to consider how such regulations could influence the future landscape and whether they align with the foundational principles of cryptocurrency innovation.
