New Guidelines for Crypto Firms Affecting EU Customers’ Stablecoin Holdings

The European Securities and Markets Authority (ESMA) has issued new guidance impacting the services offered by authorized cryptocurrency firms to customers in the EU regarding certain stablecoins. Under the new rules, these firms must halt all services that allow customers to purchase, trade, or otherwise increase their holdings of the impacted stablecoins.

Scope of the Regulations

The regulations encompass a wide range of services related to cryptocurrencies, including:

  • Exchange services
  • Trade execution
  • Transfers
  • Custody
  • Administration
  • Advice
  • Portfolio management

Timeline for Compliance

National regulators have been instructed to ensure that any remaining customer holdings of the affected stablecoins are settled promptly, with a maximum window of three months after the publication of the guidance. This deadline is set for January 8, 2027, marking a clear timeline for compliance.

Limited Services Temporarily Available

During this three-month wind-down period, platforms may still offer limited services to manage existing customer holdings. These services can include:

  • Selling the tokens
  • Converting them to other assets
  • Withdrawing
  • Transferring to other wallets
  • Safekeeping

However, these platforms are prohibited from allowing new purchases, promotional activities, trading, or maintaining market availability of the affected stablecoins.

Customer Guidance

For EU users holding USDT on exchanges, the next steps will depend on the specific platform they utilize. Some exchanges may allow sales or withdrawals within the transition period, while others might implement stricter cutoff dates sooner.

Regulatory Implications

ESMA has highlighted that retaining noncompliant stablecoins on authorized platforms could undermine the important reserve, redemption, governance, and disclosure standards stipulated by the Markets in Crypto-Assets (MiCA) regulation aimed at authorized issuers.

Role of National Regulators

The guidance provided by ESMA primarily addresses national regulators. These authorities will determine how each cryptocurrency platform manages its remaining client balances, ensuring adherence to the imposed three-month deadline.

As the situation develops, affected firms and their customers must stay informed of regulatory changes and their implications for crypto transactions and holdings within the EU.
